The Palau Senate Leader is committed to respecting the intellectual property rights of others and expects users of its services to do the same. This policy outlines the procedures for filing a Digital Millennium Copyright Act (DMCA) takedown notice and for submitting a counter-notification regarding alleged copyright infringement.

We comply with the provisions of the DMCA and other applicable intellectual property laws. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our website or services, please notify us by following the instructions below.

Filing a DMCA Takedown Notice

If you are a copyright owner or an agent thereof and believe that any content hosted on our platform infringes upon your copyrights, you may submit a written DMCA Takedown Notice containing the following information. Please be aware that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that content is infringing your copyrights.

  1. Identification of the copyrighted work claimed to have been infringed: Provide specific details, such as a URL to the original work or a copy of the copyrighted work.
  2. Identification of the material that is claimed to be infringing: Provide specific URLs or other identifying information of the material that you claim is infringing your copyrighted work.
  3. Sufficient information to permit us to contact you: This includes your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a Counter-Notification. Upon receipt of a valid Counter-Notification, we may reinstate the material in question. Please be aware that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that content is not infringing the copyrights of others.

  • Identification of the material that has been removed or to which access has been disabled: Provide the specific URLs or other identifying information of the material.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which the Palau Senate Leader may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.
